General terms and conditions (AGB's) and right of withdrawal for YTTP individual course bookings, points cards and memberships
1. Scope and contract partner
These terms and conditions apply to all service contracts concluded via bsport or other digital booking channels with one of the following companies:

Hereinafter together: “The Studio” or “YTTP”. The relevant contractual partner is the company via whose location or platform the booking is made; this is shown in the booking process. Managing directors authorized to represent the holding company: Jan Graffelder, Maria Graffelder.
The range of services includes Reformer Pilates (Fundamentals 1—3, Creative Classes), Mat Pilates and Functional Fitness (including STRONG, ENGINE, METX, MOVE, TEAMS) at all German locations.
These terms and conditions apply to consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB), unless expressly differentiated.
2. Conclusion of contract
The membership contract is concluded exclusively through Bsport. Upon completion of the booking process, the member bindingly declares his membership; the studio confirms the conclusion of the contract electronically.
No right of withdrawal: Memberships and courses offered in the area of sports and leisure on specific dates are leisure services within the meaning of Section 312g (2) No. 9 BGB. There is no legal right of withdrawal for such contracts, as the service is bound to a fixed date and the studio must keep capacity free. The studio expressly points this out during the booking process by means of a mandatory checkbox and obtains confirmation from the member. Instead, the cancellation rules in § 6 apply.
3. Types and scope of benefits
a) Membership fees of current contracts — price adjustment
The studio is entitled to adjust the membership fee of an ongoing membership contract if (i) the statutory sales tax changes or (ii) there are proven significant cost increases (e.g. energy, rent). Adjustments under (ii) are limited to a maximum of 5% of the applicable membership fee per calendar year. Each adjustment will be notified to the member in writing at least six weeks in advance. The adjustment is considered approved if the member does not object in writing within four weeks of receipt; this right of objection and the legal consequences of silence will be pointed out separately and emphasized in the notification. In the event of an objection, the studio has an extraordinary right of termination.
If the member objects in due time, the contract continues under the previous conditions until the studio makes use of its right of termination.
b) All other prices
For all other prices — in particular for individual courses, points cards, training and membership prices for new contracts — the studio reserves the right to adjust them at any time. Only the price valid at the time of the respective booking or conclusion of the contract is decisive. Services that have already been paid for are not affected by a price change.
c) Current price offer
The current offer with all prices is available at any time at www.yttp.de/prices retrievable.
d) Scope of services
The member receives the right to participate in the courses of the respective studio as part of the selected membership. Booking and administration are carried out exclusively via bsport. The studio is entitled to adapt, introduce or discontinue course formats; a significant change in the overall character of the membership gives the member a special right of termination.
4. Urban Sports Club, Wellhub and third-party platforms
The studio cooperates with third-party platforms (in particular Urban Sports Club/USC, Wellhub). The following applies to courses booked via third-party platforms:
Contracting partner: Members who book exclusively via third-party platforms do not conclude an independent membership contract with the studio. The terms of use of the respective third-party platform are decisive. In this respect, the studio only acts as a service provider.
cancelling: The 12-hour cancellation periods in accordance with § 7 also apply to third-party platform bookings, unless the third-party platform makes any overriding deviating rules.
End of cooperation: When a third-party platform cooperation is terminated, affected users will be informed at least four weeks in advance. Memberships concluded directly with the studio remain unaffected.
liability: The studio is not liable for malfunctions, data loss or restrictions in the area of responsibility of third-party platforms.
5. Payment terms
a) Payment for the booked services is made directly via the website using the BSport tool. Payment methods accepted are specified during the booking process.
b) Both in the case of contracts that can be terminated monthly and annually, the monthly debit of the membership fee automatically.
c) If the member defaults on payment, the studio is entitled to temporarily block access to course bookings until payment has been made.
d) The studio may charge reminder fees and default interest at the statutory rate.
e) With Chargebacks or failed withdrawals Is the studio entitled to pay the fees charged by the payment service provider including a processing fee of 7.50€ To be passed on to the member.
6. Terms and cancellations
a) Memberships that can be cancelled on a monthly basis
— Duration: unlimited
— Cancellation: possible on a monthly basis, with a notice period of 7 days to the end of the month
— The cancellation is made in text form (e.g. via the contact form) or directly via the BSport platform
b) annual memberships
— Minimum term: 12 months
— After expiry of the minimum term, the contract is automatically extended for an indefinite period if it is not terminated in due time.
— Cancellation: no later than 4 weeks before expiry of the minimum term via bsport or in text form to the studio.
c) Extraordinary termination
An extraordinary termination for good cause remains unaffected. Important reasons include in particular: permanent illness (medical certificate), relocation more than 30 km away to the nearest YTTP location (the official re-registration certificate is valid as proof), permanent closure of the site used.
7. Cancellations and expiry of funds
a) Memberships with limited courses (4 or 8 classes/month)
— Cancellation up to 12 hours before the course starts → Course credit will be credited again.
— Cancellation within 12 hours before the course starts → Course credit expires.
— No-show → course credit also expires.
b) Unlimited memberships
— In the event of three (3) unexcused non-shows within one calendar month, access to the course booking will be blocked for four (4) calendar days.
— This suspension is for the fair use of course capacities.
c) Scorecards:
— Booked courses can be canceled or rebooked free of charge up to 12 hours before the start of the course.
— Cancellation within 12 hours before the course starts → Course credit expires.
In the event of technical failures on the booking platform, the cancellation can be sent by e-mail to hello@yttp.de be explained. The time of receipt of the email is decisive.
8. Suspension, suspension and closure
a) The studio is eligible, in the event of late payment, repeated misconduct or violations of house rules to temporarily block access.
The following rules of conduct apply to all courses:
- Please arrive at least 5-10 minutes before the course starts so as not to interrupt the start.
- Switch your phone off or into flight mode during class
- Be respectful of participants and trainers.
- Maintain personal hygiene and clean the mats and equipment used after the course — disinfectants are available.
- If you are late or have to leave early, please do so quietly and without disrupting the course.
- Inform trainers of health problems or injuries before the course starts so that appropriate consideration can be given.
b) A temporary shutdown (e.g. in case of illness, pregnancy, prolonged absence) is possible upon presentation of suitable proof and with the consent of the studio. The contract period is extended in accordance with the closure period. Decommissioning is limited to a total of 3 months per contract year. In the event of pregnancy, breastfeeding may be granted for the entire duration of the pregnancy and up to 3 months after birth.
9. Transferability of membership
a) Membership is personal and not transferable.
b) Administration is carried out exclusively via the personal BSport user account.
10. Health fitness and liability
a) By booking, the member assures that he is physically and healthily suitable for taking part in the course. If you have health problems (including cardiovascular diseases, pregnancy, intervertebral disc problems, condition after surgery), it is recommended that you seek medical advice in advance.
b) For functional fitness formats (STRONG, ENGINE, METX, MOVE, etc.), the member confirms by booking that they have taken note of the increased physical intensity and that there are no health contraindications for high-intensity training.
c) What we are not liable for: The studio assumes no liability for self-inflicted accidents or injuries during courses. The same applies to damage that occurs despite correct course management — unless the studio is intentional or gross negligence.
d) What we are liable for: We are fully liable for damage to life, body and health — regardless of how it occurred.
We are also liable if we breach one of our core obligations. Core obligations are obligations that are so essential for the provision of services that their absence jeopardizes the meaning of the contract — for example, professional course instruction by qualified personnel or the provision of safe course rooms and equipment. In these cases, our liability is limited to the damage that is typically foreseeable when using a fitness studio.
11. Minors
Participation in courses requires a minimum age of 16 years. Persons between 16 and 17 years of age require the written consent of a parent or legal guardian; this is obtained technically during the booking process through a separate mandatory checkbox. For high-intensity formats (functional fitness), there is a minimum age of 18 years. The respective age restrictions are shown in the booking system.
12. data protection
Protecting your personal data is important to us. All personal data collected when booking and using our website is processed in accordance with legal regulations (GDPR and TTDSG). For more information, please see our Privacy statement.
13. Amendments to the terms and conditions
Changes to the terms and conditions will be notified by email to the address stored in your BSport account. The member is required to keep this address up to date.
Changes to the terms and conditions will be notified to the member at least six weeks in advance. They are considered approved if the member does not object in writing within four weeks of receipt. This right of objection and the legal consequences of silence are pointed out separately and emphasized in the communication. In the event of a timely objection, the studio has an extraordinary right of termination; until then, the contract will continue under the previous conditions.
14. Final provisions
The law of the Federal Republic of Germany applies. Cologne is the exclusive place of jurisdiction for merchants and legal entities under public law. For consumers, the legal place of jurisdiction at their place of residence applies. Should individual provisions be ineffective, the effectiveness of the remaining provisions remains unaffected; the ineffective provision will be replaced by an effective provision that is close to the economic purpose (severance clause).

2. Subject matter of the contract
YTTP Academy GmbH offers the following education and training courses:
- Mat Pilates teacher training (face-to-face)
- Reformer Pilates teacher training (presence)
- Functional Fitness trainer training (presence)
- Continuing education modules and workshops
The training courses provide theoretical and practical knowledge for working as a certified teacher, provided that personal suitability is met.

Registration is only possible via our website www.yttp.de.
For a training module to take place, a Minimum number of participants required by 10 people. If this figure is not reached, YTTP reserves the right to cancel or postpone training to a later date. If the training is postponed to a later date, the registered participants have a special right of termination, which can be exercised within 7 days of the new date being announced.
In the event of complete cancellation by YTTP Academy, participants also have a special right of termination; payments made will be refunded in full.
4. Right of Withdrawal and Tax Note
No right of withdrawal: According to Section 312g Paragraph 2 No. 9 BGB, there is no right of withdrawal for face-to-face courses on specific dates (leisure service with a fixed date). During the booking process, a mandatory checkbox expressly indicates this exclusion and confirmation is obtained from the participant. The cancellation rules in § 6 apply.
Sales tax: Pilates and functional fitness courses offered by YTTP Academy GmbH are exempt from sales tax in accordance with Section 4 No. 21 letter a double letter bb UStG. The corresponding certificate from the competent state authority is available. The prices shown are therefore net prices.
5. rebooking
Rebooking by written declaration sent by e-mail to academy@yttp.de. The date of rebooking is determined by the date of receipt of the declaration by YTTP Academy, not the date of submission.
- Up to 12 weeks before the start of the event: free rebooking
- Up to 8 weeks before the start of the event: 25% of the event price as an additional charge
- Up to 4 weeks before the start of the event: 50% of the event price as an additional charge
- Less than 4 weeks before the start of the event: rebooking not possible
If a rebooking is agreed, the terms and conditions valid at the time of rebooking apply to the new booking, which are sent with the rebooking agreement. Rebooking is only possible with consent to the applicable contract terms.
6. Cancellation of training
Cancellation by written statement sent by email to academy@yttp.de. The date of cancellation is determined by the date of receipt of the declaration by YTTP Academy, not the date of submission.
- Up to 12 weeks before the start of the course: free cancellation & refund
- Up to 8 weeks before the start of the course: 75% of the course fee will be refunded
- Up to 4 weeks before the start of the course: 50% of the course fee will be refunded
- Up to 2 weeks before the start of the course: 25% of the course fee will be refunded
- Less than 2 weeks before the start of the course or after the start of the course: no refund
The cancellation fees reflect the actual preparation and organizational costs, which are increasingly incurred as the lead time becomes shorter and can no longer be covered elsewhere.
7. Interruption and catch-up rights
If prevented due to illness, injury or pregnancy after the start of the course, outstanding units can be made up for in the next available training course, provided that this is not fully booked. There are no separate course fees for catch-up participation. The catch-up claim expires after 3 years from the date of interruption. In the event of permanent prevention due to health reasons (medical certificate), the course fee will be refunded proportionally for the unused course duration.
8. Organizers, location and teaching staff
The organizer is YTTP Academy GmbH. Face-to-face courses take place in YTTP studios or suitable partner locations; the exact venue will be announced upon registration. YTTP Academy reserves the right to change locations and dates for justified reasons and will inform participants immediately. In the event of significant changes that affect the overall nature of the training, the participant has a special right of termination; payments made will be refunded on a pro rata basis. There is no entitlement to training by specific teachers; the use of qualified substitute staff does not entitle you to resign.
9. liability
The participant must treat the premises, facilities and equipment with care and is liable for damage caused negligently or intentionally. YTTP Academy GmbH assumes no liability for damage to items brought along, such as clothing, valuables or money.
By registering, the participant confirms that they have met the physical and psychological demands of the training. Participation is at your own risk.
What we are not responsible for: YTTP Academy assumes no liability for injuries or damage to health resulting from our own misconduct or in spite of correct instructions — unless we commit intent or gross negligence. In the event of a dispute, it is the responsibility of the participant to prove that the damage was not caused by their own misconduct, insofar as this is reasonable.
What we are responsible for: We are fully liable for damage to life, body and health — regardless of how it was caused.
We are also liable if we breach one of our core obligations. Core duties are duties that are so essential to training that their absence jeopardizes the meaning of the contract — for example, professional guidance from qualified teachers or the provision of safe spaces and equipment. In these cases, our liability is limited to the damage that is typically foreseeable during such training.
10. Data protection
The person responsible is YTTP Academy GmbH. Health data (Art. 9 GDPR) is processed exclusively for course delivery and is particularly protected. Privacy statement: www.yttp.de/privacy policy.
11. Final provisions
No oral agreements have been made regarding this training agreement. Amendments and additions to this agreement must be made in writing.
Should individual provisions of these terms and conditions be invalid or unenforceable, the effectiveness of the remaining provisions remains unaffected. The ineffective provision will be replaced by an effective provision that comes closest to the economic purpose of the ineffective provision.
The law of the Federal Republic of Germany applies. The place of jurisdiction for merchants is Cologne. For consumers, the legal place of jurisdiction at the consumer's place of residence applies.

These terms and conditions apply in addition to the terms and conditions for face-to-face training (“Training” tab on this page). Please read both documents completely. In the event of contradictions between the two, the following provisions of this tab shall prevail.

1. Platforms and service provision
Online training is provided via Memberspot. Payment is processed via Ablefy. After successful payment, the access link will be sent via email within 24 hours.
YTTP Academy is not responsible for memberspot or Ablefy outages or accessibility issues that are beyond YTTP Academy's control.
YTTP Academy points out that Memberspot and Ablefy may process personal data on servers located outside the EU/EEA. In this case, appropriate guarantees are ensured in accordance with Art. 46 GDPR (standard contractual clauses). For more information, see the privacy policy at www.yttp.de/privacy policy.
2. Right of withdrawal for digital content
For online training courses, the statutory right of withdrawal of 14 days from the conclusion of the contract applies as long as execution has not yet begun.
Expiry of the right of withdrawal: The right of withdrawal expires in accordance with Section 356 (5) BGB if the participant has expressly confirmed in the ordering process (i) that execution should begin before the 14-day withdrawal period has expired and (ii) that he/she thus loses his/her right of withdrawal. Without this express confirmation, access to the content will be activated 14 days after the conclusion of the contract, unless a withdrawal has been received.

3. No cancellation after content approval
Once the course content has been approved, cancellation and refund is no longer possible, unless the statutory right of withdrawal has not yet expired (see § 2).
4. No minimum number of participants
There is no minimum number of participants for online training courses. A cancellation for this reason is excluded.
5. Right of access and license of use
With full payment, the participant receives a personal, non-transferable right to use the content provided for a period of 3 months. The period starts at the time of actual activation of the access link, not at the time of payment. At the end of this period, access to the content expires automatically. The exact expiry time will be notified by email after activation.
Access is limited to a maximum of 5 registered devices. Simultaneous use on more than one device is not technically possible. These restrictions serve to protect course content and are enforced via the fingerprint function of the Memberspot platform.
The transfer of access data, the reproduction or redistribution of course content is prohibited and gives rise to claims for damages. Course content may not be used for your own commercial training products.
6. Data protection and third-party platforms
Memberspot and Ablefy are contractually bound as contract processors in accordance with Art. 28 GDPR. Standard Contractual Clauses (SCCs) are used when processing data outside the EU/EEA. For more information, see www.yttp.de/privacy policy.
7. Final provisions
In addition, the terms and conditions for face-to-face training (“Training” tab on this page) apply, in particular the regulations on rebooking, cancellation, interruption, organizers and liability.
